Terms of Sale and Return

1. General Provisions

1.1. These terms and conditions apply when purchasing goods from the L-Kõrtsi Talu OÜ online store (hereinafter the “E-store”).

1.2. The seller is L-Kõrtsi Talu OÜ, registration code 12792348, address Kõrtsi, Lapetukme village, Elva parish, Tartu County, Estonia, email: kortsitalumaitsed@gmail.com, phone: +372 555 67 238.

1.3. These terms are drawn up in accordance with the laws of the Republic of Estonia and the European Union.


2. Orders and Prices

2.1. All prices in the E-store are stated in euros and include applicable value added tax (VAT), where applicable.

2.2. Product availability and prices may change without prior notice. If it is not possible to fulfill an order, the consumer will be notified as soon as possible and any paid amount will be refunded.

2.3. To place an order, the consumer must select the desired products, add them to the shopping cart, and complete payment.


3. Payment

3.1. Payments may be made via bank link, card payment, or bank transfer.

3.2. The order is considered confirmed once full payment has been received.


4. Delivery

4.1. Products are shipped within Estonia and, by agreement, to other countries.

4.2. The delivery time is generally 3–7 working days from receipt of payment.

4.3. In exceptional cases, delivery may take up to 14 calendar days.

4.4. If the consumer fails to collect the ordered goods from a parcel locker or other agreed delivery location within the time limit set by the carrier and the shipment is returned to the seller, this shall be deemed a failure to perform the order by the consumer.

4.4.1. In such case, the seller has the right to deduct from any refundable amount all actual delivery-related costs incurred, including:

  • the original shipping cost (even if free shipping was offered as part of a promotional campaign),

  • the return shipping cost charged to the seller.

4.4.2. If the returned goods have lost their resaleability due to the consumer’s inaction (including, but not limited to, improper storage conditions, temperature exposure, or multiple transport cycles), the seller has the right to withhold the refund to the extent that the goods have been destroyed or their value has decreased.

4.4.3. If the consumer requests re-dispatch of the goods, the consumer shall bear the new delivery costs in accordance with the applicable price list.


5. Right of Withdrawal

5.1. The consumer has the right to withdraw from the purchase contract within 14 days of receiving the goods without giving any reason.

5.2. To exercise the right of withdrawal, the consumer must submit a clear statement of withdrawal within the 14-day period.

5.3. Returned goods must be unopened, in their original packaging, and in the same condition as when received.

5.4. When exercising the right of withdrawal, the seller will refund the product price and the original delivery cost to the extent of the cheapest offered delivery method.

5.5. The cost of returning the goods (shipping from the consumer back to the seller) is borne by the consumer, except when the return is due to an incorrect or defective product.

5.6. The seller may withhold the refund until the returned goods have been received or until the consumer has provided proof of having returned the goods.

5.7. The refund will be made within 14 days from receipt of the withdrawal notice, provided that the goods have been returned or proof of return has been submitted.


6. Exceptions to the Right of Withdrawal

6.1. As the products sold in the E-store (syrups, jams, sauces, and mustards) are food items sealed in glass jars, they cannot be returned after opening for hygiene and food safety reasons.

6.2. If the product has been opened or damaged in a way that prevents it from being resold, the consumer loses the right of withdrawal.

6.3. Only unopened and undamaged products in their original packaging may be returned.


7. Complaints

7.1. The seller is responsible for any non-conformity of the goods sold to the consumer that appears within the product’s stated shelf life. Complaints cannot be made after the expiration date.

7.2. To file a complaint, the consumer must send an email to kortsitalumaitsed@gmail.com including the order number, product name, and a description of the issue.

7.3. The consumer must notify the seller of any defect within a reasonable time after discovering it, but no later than two months from its appearance.

7.4. If the product is found to be defective or does not match its description, the consumer has the right to request repair, replacement, or a refund in accordance with applicable law.


8. Liability

8.1. The seller is not liable for:

  • damage caused by improper use or storage of the product;

  • damage resulting from failure to follow storage instructions on the packaging;

  • natural variations or characteristics of handmade products (such as slight differences in taste, texture, or color between batches).

8.2. The consumer is responsible for the accuracy of the information provided when placing an order.


9. Processing of Personal Data

9.1. All personal data submitted in the E-store is treated confidentially and used solely for fulfilling orders and maintaining customer communication.

9.2. Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the laws of the Republic of Estonia.


10. Dispute Resolution

10.1. All disputes shall be resolved in accordance with the laws of the Republic of Estonia.

10.2. Consumers have the right to contact the Consumer Protection and Technical Regulatory Authority (TTJA) or use the European Union’s Online Dispute Resolution platform.
